TERMS & CONDITIONS
PLEASE READ CAREFULLY BEFORE BOOKING YOUR TRIP WITH SALTERRA VOYAGES.
The following terms and conditions apply to any trip booked with Salterra, LLC (hereinafter referred to as “Salterra,” “SV,” “Salterra Voyages”, “our,” or “us”). By booking a trip with Salterra you (hereinafter referred to as, “you” “your” or “traveler”) acknowledge that you (i) are 18 years of age or older, (ii) understand and accept these terms and conditions (the “Terms and Conditions”), (iii) are entering into a contractual relationship with Salterra, and (iv) you agree to enter into a stand-alone Release and Waiver of Liability and Assumption of Risk consistent with the terms hereof prior to the departure date for the benefit of Salterra and the Salterra Released Parties if requested by Salterra.
PRICE POLICY; TRIP DEPOSIT; INVOICING; FINAL PAYMENT
All trip prices are as posted on Salterra website at the time of booking and do not include airfare (“Trip Cost”). Trips are priced per person, based on shared occupancy as further specified in these Terms and Conditions and the itinerary for each trip. Single rooms may be available at an additional cost and the prices will be listed where applicable. Prior to booking, prices are subject to change without notice. If you are using our payment plan option, you must submit a non-refundable, non-transferable, per person deposit (equivalent to the first month’s installment payment or other amount determined by Salterra in its sole discretion) at the time of booking to reserve your space (“Deposit”). You may submit payments to Salterra by online transfers or credit card.
Payment of the required deposit indicates that you have read and accepted these Terms and Conditions. Once your deposit has been received and processed by Salterra, you will receive confirmation of your booking (subject to availability) by email. After booking, Salterra may send you an additional email with the payment plan dates and details of the trip. If you fail to make a payment by the payment due date, we shall be entitled in our discretion to treat the missed payment as a breach of contract, cancel your reservation, and/or impose the cancellation, and/or/ a $30 late fee as specified in this agreement. In the event of a late payment, Salterra may assess a $30 late fee for every week a payment is late in addition, or in lieu of, the other remedies specified herein. In the event Salterra elects to cancel a reservation, Salterra retains the right to assign your spot to the next eligible traveler on the waitlist without any refund to you.
Each traveler is responsible for verifying the information and notifying Salterra of any discrepancies or errors. If there is an error Salterra will send a revised invoice to reflect the correct pricing. Salterra may cancel your booking if final payment is not received by the due date. Final payment is due on the date specified in the booking confirmation (typically 2 months before the start of
the trip).
Regardless of the deposit amount or any other terms specified within the booking confirmation, you will be required to adhere to the following payment schedule when booking trips within 60 days of a trip start date:
60 days prior to trip: ……….. 50% of the total Trip Cost (which includes the Deposit)
30 days prior to trip: ……….. 100% of the total Trip Cost (which includes the Deposit)
CHANGES
1. Changes.
Salterra reserves the right to make changes to any and all aspects of the trip (which may include without limitation changes to the types and/or timing of activities available during the trip, items and/or services included with the trip, accommodations, the itinerary, and/or the nature of the trip) if, in Salterra’s sole discretion: (i), Salterra deems it necessary to do so due to conditions that may be hazardous, dangerous, or otherwise adverse or threatening; (ii), if an act or omission of a third party prevents any such aspects of the trip or any portion of the trip;, or (iii) for any other reason considered commercially necessary by Salterra. You will not be eligible for any refunds of any amounts based on any such changes to by Salterra.
2. Cancellations/Refunds.
2.1. By Salterra.
Salterra reserves the right to cancel your reservation if any required payment is not received on or before the applicable payment due date and you will not be eligible for any refunds of any amounts. Company further reserves the right to cancel the trip prior to the departure date in the event an insufficient number of registrants are confirmed for the trip or for any other commercial reason in Salterra’s sole discretion and, in such an event, you will receive a full refund of the amount you remitted to Salterra, but in no event will Salterra be responsible for any other amount, including preparation costs, airfare, travel documents, or any other losses or claimed damages. Salterra may, but will have no obligation to reschedule the trip.
In the event a trip is rescheduled, you will be notified and any payments made will roll over to the new trip dates. No refunds will be issued for rescheduled trips except in accordance with these Terms and Conditions. Salterra will not be responsible for any additional costs or any fees incurred by you due to the cancellation or rescheduling of a trip. For the avoidance of doubt, the cost of airline tickets or other travel arrangements, not made by Salterra shall be the sole responsibility of the traveler.
2.2. By You.
No refunds.
If an emergency, all cancellations by you must be in writing and emailed (info@salterravoyages.com) to Salterra at the contact email address specified on the Salterra website.
If cancellation takes place prior to the start date all payments will be forfeited. You are responsible for locating and identifying any transferee for a trip and such transferee is responsible for full payment of the Trip Cost in accordance with these Terms and Conditions.
2.3. Why are my payments non-refundable?
Our vendor/partner(s) -- hotels, guest speakers, excursion companies, etc. -- require upfront commitments that we must adhere to. When we offer a package to you we have to ensure, through good-faith payments, that you will attend the trip.
HEALTH AND FITNESS ELIGIBILITY
You represent that you are over the age of eighteen (18) and are healthy, in good physical and mental health, and are at a level appropriate to participate in, and are fully capable of participating in, the trip. You further represent that you do not suffer from any medical conditions or disabilities that may restrict, limit, prevent, or preclude your participation in the trip, including any physical activities. You have consulted with your physician and your physician has authorized you to participate in the trip, including any physical activities. You will discuss and address any questions or concerns you may have about your physical or mental health with the appropriate health care professional prior to the departure date. Documentation from your physician confirming your clearance to participate in the trip can be provided upon request by Salterra. If, at any time, you have any doubts about your physical condition or fitness to participate in any aspect of the trip either before or during the trip, you will cease participation in the same and seek appropriate medical attention. YOU ARE HEREBY ADVISED THAT THE TRIP MAY TAKE PLACE IN REMOTE AREAS WHERE THERE IS LITTLE OR NO ACCESS TO TRADITIONAL MEDICAL SERVICES OR HOSPITAL FACILITIES FOR SERIOUS HEALTH ISSUES (OR YOUR PARTICULAR HEALTH ISSUES). YOU ARE FURTHER ADVISED THAT ANY MEDICAL OR EVACUATION EXPENSES WILL BE YOUR SOLE RESPONSIBILITY. As a result, we strongly encourage you to purchase travel insurance with appropriate coverage for your needs. We reserve the right in our sole discretion to refuse your participation in the trip, physical activities, and/or any other activities, due to medical, fitness, or other grounds. Salterra also reserves the right to deny participation in the trip or any related activities at any time to individuals demonstrating behavior that may result in injury to themselves or others.
ASSUMPTION OF RISK
You understand that serious accidents may occur during the trip either as part of the physical activities or otherwise and that participants can sustain fatal and/or serious personal injury. As stated above, the trip may take place in a remote location where there is little or no access to
traditional medical services or hospital facilities for serious and/or particular health issues. You may also be visiting places where the political, cultural, and geographical attributes of the location present risks and physical challenges that are greater than those present in your country of residence. It is your own responsibility to familiarize yourself with all possible relevant travel information in connection with your participation in the trip. Understanding and in full consideration of the foregoing, you agree to solely and exclusively assume full and complete responsibility for and the risks inherent in travel, in and engaging in physical activity, and for otherwise attending the trip which may include injury, death, property damage, and/or any other kind of Liability, whether foreseen or unforeseen, which may occur during your participation in the trip. You acknowledge that your decision to participate in the trip is made in full consideration of the foregoing information and that you solely and exclusively assume the risks involved with participating in the trip including, but not limited to, any and all risks of injury, disability, death, or
property damage, whether caused by the negligence of Salterra, any Salterra Released Party or any other attendee on the trip. IN NO EVENT WILL Salterra, ANY OF ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, VOLUNTEERS, GUIDES, AFFILIATES, SUCCESSORS, OR ASSIGNS (collectively, the “Salterra Released Parties” or each a “Salterra Released Party”), BE LIABLE FOR ANY LIABILITIES ARISING FROM OR IN CONNECTION WITH YOUR PARTICIPATION IN THE TRIP.
INJURY
In the event you are injured while participating in the trip, you agree to assume all financial obligations and liability for any and all medical costs you incur. You acknowledge and agree that IN NO EVENT SHALL Salterra AND/OR THE Salterra RELEASED PARTIES BE LIABLE OR RESPONSIBLE FOR ANY LOSSES OR LIABILITIES ARISING OUT OF YOUR PARTICIPATION IN THE TRIP.
WAIVER OF LIABILITY AND RELEASE
In consideration for participating in the trip, YOU VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR AND HEREBY RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS, AND COVENANT NOT TO SUE THE Salterra RELEASED PARTIES FOR ANY AND ALL CLAIMS, DEMANDS, ACTIONS, CAUSES OF ACTION, AND/OR LOSSES (including but not limited to any exemplary, direct, indirect, incidental, special, consequential, punitive, or other damages, medical expenses, lost wages/income, loss of services, lost profits, property damage, pain, illness, and death) (collectively “liabilities”) WHATSOEVER ARISING OUT OF OR IN ANY WAY RELATED TO YOUR TRAVEL TO AND/OR PARTICIPATION IN THE TRIP AND/OR ANY ACTIVITIES CONDUCTED IN CONNECTION THEREWITH, REGARDLESS OF WHETHER SUCH LIABILITIES ARE CAUSED BY THE NEGLIGENCE OF ANY OF SALTERRA VOYAGES RELEASED PARTIES OR OTHERWISE, AND REGARDLESS OF WHETHER SUCH LIABILITY ARISES IN TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ANY SALTERRA VOYAGES RELEASE PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LIABILITIES, TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW. You have been advised and urged to obtain travel insurance to cover against Liabilities resulting from trip cancellation or interruption, weather, natural disaster, strike, illness, job reasons, accident, sickness, evacuation, pre-existing medical conditions, baggage delay, loss, theft, and other Liabilities associated with travel and your participation in the trip. You acknowledge that whether or not you elect to purchase or not purchase travel insurance, you will not look to any of the Salterra Released Parties for reimbursement for any Liabilities suffered or occurring during your travel and/or participation in the trip.
GRATUITIES
Gratuities for your tour director, local hosts, local guides and skippers or drivers are not included in the trip price (unless otherwise noted in pricing details) and are discretionary.
NOT INCLUDED IN THE TRIP PRICE
The following charges are not included in the trip price unless otherwise noted: (i) airfare to and from the start of your trip; (ii) airline baggage fees including checked and/or excess baggage fees; (iii) passports; (iv) visas and vaccinations; (v) tips to your tour directors, local hosts, drivers, local guides, rest room attendants; (vi) gratuities on ferries, trains; (vii) laundry; (viii) telephone fees or expenses; (ix) minibar; (x) alcoholic beverages, other beverages, and food outside of the contracted Salterra menu as presented at accommodations or restaurants (these extra items will be billed to you before leaving the accommodation or restaurant); (xi) optional excursions; (xii) porterage at airports and train stations; (xiii) travel insurance; and (xiv) all other items of a personal nature.
GUEST INFLUENCERS/SPEAKERS
If any guest influencer/speaker, guide or attendee contemplated in the trip itinerary is prevented (directly or indirectly) from performing any of its obligations under this agreement by for any reason whatsoever including, but not limited to, of any Act of God, sickness, strike, trade dispute, fire, inclement weather, breakdown, interruption of transportation networks/means, government or political action, acts of war or terrorism, acts or omissions of a third party, or for any other cause whatsoever outside of Salterra’s reasonable control, Salterra will be under no liability whatsoever to you and may, at Salterra’s discretion, by written notice to you, either cancel the trip or take any other reasonable action.
AIR ARRANGEMENTS TO TRIP DESTINATIONS
Travelers must purchase their own airline tickets to the trip destination. Salterra will not arrange air transportation and shall not be responsible or liable for a traveler’s airfare, airline ticket, or air travel arrangements. All issues with your air travel shall be resolved with the respective airline on which you are ticketed. In the event the airline cancels, reschedules, or delays a flight for any reason or you miss your departure flight or connection, no refunds will be provided by Salterra for missed portions of the trip. You are fully responsible for any additional expenses you may incur prior to joining the trip if you miss your departure flight or connecting flight including any additional travel expenses or transfer fees that may be necessary to join the trip. Salterra recommends all travelers purchase travel insurance with provisions to cover these unexpected expenses.
INSURANCE
Salterra recommends traveler’s to purchase traveler’s/medical insurance for your Salterra trip. Some trips may require traveler’s/medical insurance which will be highlighted on the destination page. By signing up and making any payment to us, you acknowledge this recommendation and/or requirement and that no such insurance is provided by Salterra. The insurance should cover the cost of trip cancellations, flight delays and cancellations, loss of employment, and accidents and illness suffered by you that would prevent you from traveling on your booked trip or that may occur during the trip. You should consider purchasing additional coverage to cover any money you may have spent prior to your scheduled trip departure. Travelers must submit documentation evidencing their purchase of traveler’s insurance to Salterra upon request if necessary and/or required. Salterra is not responsible for any losses you incur and/or sustain.
LANGUAGE
All tour directors, local hosts and local guides utilized by Salterra speak English. Travelers should be able to speak, read and understand English.
AUTHORITY TO REMOVE OR REFUSE TRAVELERS
In the event Salterra believes that a traveler may interfere with other traveler’s enjoyment of the trip, Salterra may, in its sole discretion, refuse to allow the traveler to commence the trip or remove a traveler from the trip. Travelers who (i) are considered a danger to themselves or others or (ii) have engaged in or are threatening to engage in behavior that may adversely affect the safety, security, comfort, enjoyment, or well-being of other travelers or Salterra representatives (including, but not limited to, behavior that is disruptive, verbally abusive, physically abusive, obnoxious, harassing, discriminatory, or obscene) or (iii) have failed or refused to following Salterra directives, recommendations, instructions, policies, or procedures, may be removed from the trip. In the event Salterra refuses transport or removes a traveler, Salterra may leave the traveler at any destination and shall not be liable or responsible for accommodations, transportation, meals, medical care, or any other expenses incurred by the traveler after refusal or removal from the trip. Salterra will not refund any portion of the price paid by any traveler who is refused or removed and Salterra will be entitled to recover from the traveler any costs or expenses incurred by Salterra in removing or refusing the traveler.
UNDERAGE TRAVELERS
Salterra requires travelers to be 18 years of age or older to book a trip and travel alone.
SPECIALTY TRIPS
On occasion, Salterra may organize trips to include family members. These specialty trips will have itineraries that are designed to include children and/or spouses (male) (“Specialty Trips”). On Specialty Trips, additional terms and conditions governing accommodations, travel requirements, etc. may apply and will be provided to the traveler prior to confirmation of booking.
SPECIAL ASSISTANCE TRAVELERS
Travelers who require special assistance due to a disability must notify Salterra when booking a trip. In the event, Salterra is unable to arrange acceptable and reasonable accommodations for special needs or disabled travelers Salterra will notify traveler and traveler will have the option to decide if they want to continue on the trip. However, Salterra shall not be responsible for any denial of services by accommodations, restaurants, or other independent suppliers during the trip. Travelers must be able to independently partake in the activities of the trip. Special needs or disabled travelers should have a qualified and physically able companion accompany them to assist them during the trip. If a traveler fails to notify Salterra of a disability requiring special attention when booking the trip, Salterra reserves the right to cancel the booking or terminate the traveler’s trip. Salterra may cancel or terminate a trip if the special needs or disabled traveler is not accompanied by a person who will provide assistance or if a traveler’s special needs or disabilities are not suitable for the trip. In the event Salterra cancels the booking or terminates the trip, Salterra will not refund or cover any costs or expenses incurred by the special needs or disabled traveler after cancellation or termination. Some activities during the trip may require travelers to engage in extensive standing, sitting, or walking and facilities or sightseeing locations may not accommodate wheelchairs. The Americans with Disabilities Act is a federal law only applicable within the U.S.; therefore facilities and accommodations for disabled individuals may be limited outside the U.S. Salterra will not refund or cover any cost or expense incurred by a special needs or disabled traveler for any missed activities due to the traveler’s inability to fully participate with the group.
VISAS, PASSPORTS, AND OTHER TRAVEL DOCUMENTATION OR REQUIREMENTS
International travel requires a passport. You must verify all requirements and obtain a passport and all necessary visas for the trip, including all health requirements, if any, as well as any and all other applicable documentation or paperwork including customs and other similar documentation and information. If you are refused entry into any country for failing to meet the entry and exit requirements, Salterra will not be liable. All visa or passport information provided by Salterra is applicable to U.S. citizens only. Non-U.S. citizens must consult with the appropriate consulates to determine if any visas or other documents are needed. For more information on passport and visa requirements, please go to the U.S. State Department website at www.travel.state.gov.
ACCOMMODATIONS
Salterra utilizes various accommodations such as yachts, and catamarans to house travelers during a trip. Each trip will vary in terms of the accommodations used. Shared room accommodations, with twin/single beds, will be provided. Single room accommodations may be available at an additional charge and must be requested at the time of booking. Room and bed preferences are not guaranteed.
SERVICE INQUIRIES AFTER THE TRIP
If a situation arises during the trip, please advise Salterra of your complaint or claims as soon as possible. Any complaint involving Salterra services or the services of its third-party suppliers must be relayed to Salterra within 7 days after completion of the trip. If not, you will forfeit any compensation or other resolution that may have been due to you.
HOLIDAYS
Certain planned activities during the trip may be unavailable if such activities fall on dates that are designated local or national holidays. In the event a planned activity is unavailable, if possible, Salterra will offer an alternative activity. No refund or discount will be given to travelers for events that are canceled due to local customs.
HEALTH; SAFETY; MEDICAL INSURANCE
Salterra endeavors to provide a safe environment and experience for its travelers but cannot protect or guard traveler from certain risk and dangers when traveling outside of the United States. During a trip travelers may be faced with forces of nature; political unrest; acts of lawlessness or terrorism; accidents or illnesses or other situations that may endanger the life of the traveler. Salterra shall not be responsible for any risks and dangers that may arise and by booking a trip with Salterra, you agree not to hold Salterra liable for any harm suffered by you during the trip. You agree to hold Salterra harmless regarding any provision of medical care or the adequacy of any care rendered. You must ensure that you are informed and aware of the applicable health requirements and recommended precautions relevant to the trip and that you carry all necessary vaccination documents, personal health information or personal medication. You run the risk of being denied entry into a country if you fail to present the required vaccination documentation. Prior to booking a trip, you should refer to U.S. Department of State’s website www.travel.state.gov for travel advice and vaccination requirements for the trip destination.
PHOTOGRAPHS
Photographs appearing on Salterra website are used solely as a representation or similar depiction of the possible facilities and attractions and Salterra travelers should not rely on those depictions. Actual facilities and attractions will vary. On some trips, Salterra may hire a photographer to take pictures of the travelers, activities, and attractions. By booking a trip with Salterra, you agree to grant Salterra permission to take and use photos of you taken during the trip by the Salterra photographer on our website and social media platforms for marketing purposes only without payment, royalties, or other compensation. Salterra may, in its sole discretion, make the pictures available to travelers as part of the trip or as an additional cost. In the event you upload your photos to Salterra website, any upload grants a perpetual license to Salterra to use your photos for marketing purposes.
OPTIONAL EXCURSIONS
Optional excursions, outside of the planned Salterra trip activities may be available for booking through local operators or other third parties. These parties are entirely independent of Salterra and do not form any part of the Salterra trip. Any optional excursion you book will not be governed by these Terms and Conditions with respect to the third-party though these Terms and Conditions will continue to govern as between you and Salterra. In booking with a third party/local operator, you will be entering into a contract with said organizer or operator and will be subject to their terms and conditions, which may include limitations of liability or exclusions. Salterra shall not be liable for any optional excursions or for any acts or omissions of the third-party/local operator, its employees or agents or any other person connected therewith, even where Salterra advertises, suggests or assists with booking an optional excursion with the third-party or local operator. Any advice or assistance on or with any optional excursions provided by any local representative does not mean or imply that the option is sold, supervised, or controlled by Salterra, or that any such advice or assistance is given on behalf of Salterra. Salterra advises travelers to check with the operator of any optional excursion for the applicable terms and conditions before booking.
WI-FI
Wi-Fi and internet connectivity may or may not be available during the trip. If available, it may be delayed, slowed, or otherwise interrupted. Salterra has no obligation to provide travelers with Wi-Fi or internet connectivity during the trip and makes no representations as to the data and information security related to any such connectivity.
PRIVACY POLICY
By using Salterra website and booking a trip with Salterra, you consent to Salterra’s use of your personal information. You acknowledge and agree that by purchasing a trip with Salterra, you consent to Salterra transmitting your personal information to our third-party suppliers, as necessary. You acknowledge that you have reviewed and agreed with the Salterra privacy policy.
THIRD PARTY PROVIDERS
Salterra is an independent Texas limited liability company acting as an intermediary to provide a trip comprised of services offered by third-party suppliers. Third-party suppliers providing trip services are not agents, employees, servants, or joint venturers of Salterra. Salterra has independent contracts with each of the suppliers for the services. All trip services provided by third-parties are subject to the terms and conditions specified in the third party supplier documents and to the laws of the countries in which the services are supplied. The third party supplier terms and conditions are available to you upon request. YOU AGREE THAT NEITHER Salterra NOR ITS REPRESENTATIVE SHALL BE LIABLE FOR ANY DAMAGE, LOSS (INCLUDING PERSONAL INJURY, DEATH, AND PROPERTY LOSS), OR EXPENSE OCCASIONED BY ANY ACT OR OMISSION OF ANY SUPPLIER PROVIDING SERVICES. After departure, if the services included in the trip cannot be supplied or there are changes in an itinerary for reasons beyond the control of Salterra, depending on the circumstance, Salterra will take reasonable action to arrange for the provision of comparable services. Any resulting additional expense will be the responsibility of travelers.
LIMITATION OF LIABILITY
To the extent permitted by law, neither Salterra nor any Salterra Released Party accept any liability in contract, tort or otherwise for any claim, injury, damage, loss, delay, additional expense or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of another traveler or third party providers over whom Salterra has no direct control, by force majeure or by any other event which is beyond Salterra’s control. Any limitation of responsibility stated for Salterra in these Terms and Conditions applies and extends to its related companies, directors, officers and agents. This limitation of liability provision does not make Salterra responsible for any costs and fees that are specifically stated as being your responsibility. Under circumstances where our liability cannot be excluded and where liability may be lawfully limited, such liability is limited to the remedies required of Salterra under applicable law.
GOVERNING LAW; DISPUTE RESOLUTION
Unless otherwise precluded by law, disputes or claims must be filed within three months following completion of the trip or are otherwise waived. This agreement shall be governed by the laws of the State of Texas, and any dispute, mediation or arbitration pertaining to this agreement musttake place and may be brought only in courts in Dallas, Texas. Mediation shall be the first form of resolution for any dispute between you and Salterra. The mediator used shall be one selected by Salterra. If the dispute cannot be resolved through mediation, the parties must proceed to binding arbitration in the State of Texas to resolve the dispute. Such arbitration proceeding shall be administered by and pursuant to the rules of the American Arbitration Association (“AAA”) by a single arbitrator to be agreed upon between you and Salterra or, if no such agreement can be reached, then by appointment in accordance with the applicable AAA rules. The prevailing party shall be entitled to receive from the other party, reasonable attorneys’ fees and reasonable cost and expenses. Arbitration against Salterra must be arbitrated on an individual basis. Disputes shall not be arbitrated on a class action basis or on behalf of the general public. You hereby waive any right to punitive damages.
AMENDMENTS
The Terms and Conditions may only be amended, modified or waived by an authorized representative of Salterra. Any such modification, amendment or waiver must be in writing.
The Terms and Conditions are subject to change. Salterra advises you to check the Salterra website for the latest version of the Terms and Conditions prior to booking your trip.
